End-User License Agreement (EULA)

1. Acceptance of Terms

By downloading, installing, accessing, or using Varsity Fanatics, you agree to be bound by this EULA. If you do not agree to this EULA, do not install or use the App.

This EULA is a legal agreement between you and Wayout Solutions, LLC.

2. License Grant

Subject to your compliance with this EULA, Wayout Solutions, LLC grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on a device you own or control; and
• Use the App solely for your personal, non-commercial use.

All rights not expressly granted to you in this EULA are reserved by Wayout Solutions, LLC.

3. Subscription and Billing

Varsity Fanatics is offered as a subscription-based service. By starting a subscription, you acknowledge and agree that:

• Your payment method will be charged by the applicable app store provider (such as Apple App Store for iOS and, when available, Google Play Store for Android).
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• All billing, payment processing, and refund requests are handled by the app store provider, not Wayout Solutions, LLC.

4. Restrictions

You agree that you will not:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Modify, adapt, translate, or create derivative works based on the App.
• Copy, distribute, sell, sublicense, rent, or lease the App or any part of it.
• Use the App for any unlawful, unauthorized, or prohibited purpose.
• Interfere with or disrupt the operation of the App or any servers or networks connected to the App.

5. Ownership

The App, including all content, data analytics, predictions, rankings, designs, logos, trademarks, and other intellectual property, is owned by Wayout Solutions, LLC or its licensors and is protected by copyright and other intellectual property laws. This EULA does not grant you any ownership interest in the App or any associated intellectual property rights.

6. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

By using the App, you consent to the collection and processing of information as described in the Privacy Policy.

7. User Content

If the App allows you to submit or upload content (such as feedback, comments, or other materials), you are solely responsible for any such content you provide.

By submitting content, you grant Wayout Solutions, LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute such content in connection with operating and improving the App.

8. Disclaimers

Varsity Fanatics provides sports statistics, rankings, and predictions for informational and entertainment purposes only. We do not guarantee the accuracy, completeness, or reliability of any data, predictions, or outcomes displayed in the App.

The App does not provide gambling, betting, or wagering services.

THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

9. Limitation of Liability

To the fullest extent permitted by law, Wayout Solutions, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the App;
• Any conduct or content of any third party related to the App;
• Any content obtained from the App; or
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall the total liability of Wayout Solutions, LLC exceed the amount you paid (if any) for access to the App in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated this EULA or if we decide to discontinue the App.

You may terminate this EULA at any time by deleting the App from your device. To stop future subscription charges, you must cancel your subscription through your app store account settings.

11. Changes to This EULA

We may update or modify this EULA from time to time. When we do, we will revise the "Last Updated" date above. Your continued use of the App after any changes to this EULA will constitute your acceptance of such changes.

12. Third-Party Services

The App may use or integrate third-party services, tools, or SDKs (such as subscription and analytics providers). Wayout Solutions, LLC is not responsible for the content, policies, or practices of any third-party services. Your use of such services is subject to their respective terms and policies.

13. Governing Law

This EULA is governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. You agree that any disputes arising under or relating to this EULA shall be brought exclusively in the state or federal courts located in Michigan.

This EULA, together with our Privacy Policy, constitutes the entire agreement between you and Wayout Solutions, LLC regarding your use of Varsity Fanatics and supersedes any prior or contemporaneous agreements, communications, or understandings, whether written or oral, relating to the App.
